This Agreement contains a mandatory arbitration clause and a class action waiver. By using the Platform, you agree that disputes will be resolved by binding arbitration and that you waive the right to participate in class actions or representative proceedings.
These Terms of Service (“Terms”) govern your access to and use of the platform, software, and services provided by LevelUp Sales Elite, Inc. (“LevelUp,” “we,” “us,” or “our”).
By registering, creating an account, or using the Platform, you confirm that:
Your use of the Platform also constitutes acceptance of our Privacy Policy.
You must be at least 18 years old to use the Platform. You may not use the Platform to compete with LevelUp or for unlawful purposes.
The individual or entity that registers is the account owner. LevelUp may suspend access if ownership disputes arise.
You are solely responsible for compliance with applicable laws, including TCPA, CAN-SPAM, GDPR, HIPAA, and PCI-DSS where applicable.
Use of the Platform is subject to our Privacy Policy. If you collect personal data from your own customers, you must maintain a privacy policy offering protections at least as strong as ours.
You are responsible for safeguarding your login credentials and all activity under your account.
You are solely responsible for all communications sent through the Platform, including SMS, MMS, and email, and for obtaining proper consent from recipients.
LevelUp is not responsible for third-party services, integrations, or their availability.
LevelUp may limit, suspend, or terminate accounts that abuse free trials or system resources.
We may modify or discontinue features of the Platform at any time.
You must comply with export control laws and may not use the Platform in embargoed countries.
AI-powered features must be used in accordance with our AI Acceptable Use Policy.
You are solely responsible for products and services sold through the Platform. LevelUp is not a marketplace.
All Platform content, software, and trademarks are owned by LevelUp or its licensors. Unauthorized use is prohibited.
The Platform is provided “as is” and “as available.” We make no warranties regarding uptime, results, or profitability.
To the maximum extent permitted by law, LevelUp’s liability is limited to the amount paid in the three (3) months preceding the claim or $100, whichever is greater.
All disputes shall be resolved by binding arbitration administered by the American Arbitration Association in Dallas, Texas. Class actions are waived.
LevelUp may suspend or terminate access for violations, non-payment, or inactivity.
By submitting your phone number, you consent to receive SMS messages from LevelUp Sales Elite, including onboarding instructions, follow-ups, customer service updates, and marketing communications.
