User Responsibilities

You agree to:

Keep your login credentials secure.

Use the Services only for lawful purposes.

Comply with all applicable laws, including consumer protection, privacy, and telemarketing laws.

Obtain all legally required consents before contacting customers through SMS, email, voice, or AI-powered communications.

You may not:

Use the Services for spam or unsolicited marketing.

Engage in unlawful, fraudulent, abusive, or deceptive activities.

Attempt to interfere with the security or operation of the Services.

Reverse engineer or copy the software except as permitted by law.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Payments

Subscription fees, service fees, and any applicable taxes are due according to your selected plan.

Failure to pay may result in suspension or termination of Services.

Unless otherwise stated, fees are non-refundable.

Intellectual Property

All software, branding, logos, graphics, training materials, website content, AI workflows, automations, and related materials remain the property of LevelUp Sales Elite or its licensors.

No ownership rights are transferred to users.

AI Services

Our AI features assist with communication and business workflows but are not guaranteed to be error-free.

Users are responsible for reviewing AI-generated content before relying on or sending it.

AI-generated responses do not constitute legal, financial, tax, medical, or other professional advice.

Third-Party Services

Some Services integrate with third-party platforms. We are not responsible for the availability, security, or performance of those external services.

Limitation of Liability

To the fullest extent permitted by law, LevelUp Sales Elite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business opportunities, or loss of data arising from the use of the Services.

Our total liability shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the claim.

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not guarantee uninterrupted operation, specific business outcomes, lead generation results, or revenue increases.

Indemnification

You agree to defend, indemnify, and hold harmless LevelUp Sales Elite, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses arising from your use of the Services or your violation of these Terms.

Termination

We may suspend or terminate access to the Services at any time for violations of these Terms or misuse of the platform.

Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

Changes

We may update these Terms at any time. Continued use of the Services constitutes acceptance of any revised Terms.
